Buying and Selling Commercial Cropping or Horticultural Land in a Reef Region

Do you have clients buying or selling commercial cropping or horticultural land in the Cape York, Wet Tropics, Burdekin, Mackay Whitsunday, Fitzroy or Burnett Mary regions? There is some important information that you, and they, need to know.

From 1 June 2021, new Queensland Government legislation requires some growers undertaking commercial cropping or horticulture on five hectares or more of land that does not have a cropping history to have a permit before they undertake any work.  A cropping history is where the land has been used for cropping or horticulture three out of the last 10 years.

Your client may need to provide or request evidence about which land has been cropped in the past. This may include photos, spray records or satellite imagery.

Permits may be transferred between landholders. Your client may request a permit to be transferred as a condition of purchase.
